Dispute Resolution & Mediation

Welcome to our Dispute Resolution section at Lezemore Solicitors. Going to court is almost always expensive, time-consuming and stressful. For that reason we treat litigation as a last resort. In the vast majority of cases there are better ways to resolve disagreements that are quicker, cheaper and less damaging to relationships.

We help clients explore every practical alternative before considering court proceedings. Our approach is straightforward: we explain the options clearly, advise on the strengths and risks of your position, and work with you to choose the route most likely to achieve a sensible outcome.

Direct negotiation

The simplest and often most effective starting point is for the parties (or their solicitors) to talk or write to each other and try to reach an agreement. A well-drafted letter setting out the issues, the legal position and a realistic proposal can resolve many disputes without any formal process. We draft these letters and conduct negotiations on your behalf where helpful.

Mediation

Mediation involves an independent, trained mediator who helps both sides discuss the dispute and explore solutions. The mediator does not decide the outcome – the parties remain in control. Mediation is confidential, relatively quick and far less expensive than court. It works particularly well for neighbour, commercial, construction and partnership disputes. Many cases settle on the day of the mediation or shortly afterwards.

Expert determination

Where a dispute turns largely on a technical or specialist issue (for example the quality of building work or the cause of a defect), expert determination can be highly effective. The parties agree to appoint an independent expert in the relevant field who reviews the evidence and makes a binding decision. We have found this process particularly successful in cases that would otherwise become a “battle of experts” in court. It is usually quicker and more cost-effective than full litigation.

Ombudsman and industry schemes

For certain types of dispute (including many involving utilities, financial services, property agents and some consumer contracts) free or low-cost ombudsman schemes are available. These can provide a binding decision without the need for court.

Arbitration is another form of alternative dispute resolution in which an independent arbitrator makes a binding decision, though we encounter it less frequently in our work.

If none of these routes resolve the matter, or if urgent court protection is needed, we can advise on and conduct litigation. Our goal, however, is always to achieve a practical and proportionate solution without the cost and delay of a full trial wherever possible.
