Court Proceedings & Resolving Disputes
The vast majority of consumer issues never go to court. Always try alternative dispute resolution (ADR) first — it's usually free, faster, and less stressful:
- Direct negotiation with the business
- Ombudsman schemes (binding on the company for many sectors like utilities, some trades)
- Mediation — neutral third party helps both sides agree (great for service disputes).
If ADR doesn't work or isn't available, court might be the next step – just remember that, except for the small claims track, if you lose your claim you will, in most, cases, be ordered to pay the other party’s legal costs. In England and Wales, claims are allocated to tracks based on value and complexity:
- Small Claims Track — up to £10,000. Informal, low costs (you usually pay your own expenses even if you win), designed for people to represent themselves. Most consumer and service disputes fit here.
- Fast Track — £10,001 to £25,000. More formal, one-day trial usually
- Intermediate Track — £25,001 to £100,000 for cases manageable in up to three days
- Multi-Track — over £100,000 or complex cases.
You can start most money claims online via Money Claim Online — it's quick and inexpensive to issue. The court decides the track after defences are filed.
